According to НОИ in connection with the Law on the State Public Insurance Budget for 2009, were adopted amendments and additions to the Social Security Code. They include changes related to determining the right and amount of cash compensation for pregnancy and childbirth, namely:

From January 1, 2009, insured persons for general illness and maternity have the right to compensation for pregnancy and childbirth instead of labor remuneration, if they have 12 months of insurance experience as insured for this risk.

The daily monetary compensation for pregnancy and childbirth is determined at the rate of 90 percent of the average daily gross remuneration or the average daily insurance income, on which insurance contributions for general illness and maternity have been paid or are due for the period of 12 calendar months, preceding the month of onset of incapacity, and cannot be greater than the average daily net remuneration for that period and less than the minimum daily wage for the country.

The term of monetary compensation for pregnancy and childbirth is extended to 410 calendar days.

Mothers (adoptive parents) for whom the benefit period of up to 315 calendar days has not expired by January 1, 2009, are en titled to pregnancy and childbirth benefits for the remainder of up to 410 calendar days.

Mothers (adoptive parents) for whom the benefit period of up to 315 calendar days has expired by January 1, 2009, but 410 calendar days have not elapsed since its commencement, are en titled to pregnancy and childbirth benefits for the remainder until end of this period.

To receive compensation for the remainder of 315 to 410 calendar days, mothers (adoptive parents) should submit leave authorization applications to their employers.

From January 1, 2009, fathers insured for general illness and maternity have the right to monetary compensation upon the birth of a child for a period of 15 calendar days, and insured fathers/adoptive parents are en titled to monetary compensation after reaching the age of 6 months age of the child for the remainder up to 410 calendar days.Until the application-declaration samples for the payment of these benefits are promulgated in the state gazette, individuals can obtain such samples from the relevant territorial divisions of the National Social Insurance Institution.

Assessment of the right and determination of the amount of benefits for fathers is carried out in the order determined for mothers/adoptive parents.

In connection with the amendments and additions to the Social Insurance Code, when filling in the "Data from the insurer/self-insured" section in the hospital sheets, insurers (self-insured persons) should keep in mind:

In the case of pregnancy and childbirth hospital sheets presented by the insured persons in item 1c) of the section "Data from the insurer/self-insured", it should be noted whether the person has 12 months of insurance experience as insured for general illness and maternity, as in item 1c) on the sick sheet "6" is corrected to "12".

When submitting applications-declarations for the payment of monetary compensation for pregnancy and childbirth and for raising a small child, it should be declared whether the person has 12 months of insurance experience as insured for general illness and maternity, with "6" being adjust to “12”.
